Acceptance of Terms

By accessing or using TurboAgency ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

Description of Service

TurboAgency is an AI-powered SaaS platform designed for marketing agencies. The Platform provides AI tools for campaign management, content creation, reporting, client management, and marketing automation. The Platform is a tool for agencies -- we do not provide marketing services directly to your clients.

Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must notify us immediately of any unauthorized access.

Subscription and Billing

• Subscriptions are billed monthly or annually based on your selected plan
• Prices are subject to change with 30 days' notice
• Payments are processed via Stripe and are non-refundable except as required by law
• We offer a 14-day free trial for new accounts
• Downgrading your plan may result in loss of access to certain features

Acceptable Use

You agree NOT to:

• Use the Platform for any unlawful purpose
• Attempt to reverse engineer, decompile, or extract source code
• Interfere with Platform security or other users' access
• Use the Platform to generate content that is illegal, harmful, or misleading
• Resell access to the Platform without authorization (white-label usage is permitted under your plan)
• Exceed your plan's usage limits or API rate limits
• Misrepresent AI-generated content as human-created when regulations require disclosure

Security Testing Prohibition

The following activities are strictly prohibited without prior written authorization from TurboAgency:

• Security testing, vulnerability scanning, or penetration testing of any kind against the Platform, its infrastructure, APIs, or related services
• Exploiting, probing, or attempting to bypass security controls, sandboxes, containers, or access boundaries
• Executing or researching known CVEs, privilege escalation techniques, or container/sandbox escape methods
• Using AI tools provided by the Platform to research, plan, or assist with security attacks, exploits, or vulnerability discovery — against this Platform or any other system
• Enumerating or probing Platform security architecture, network topology, system configurations, or infrastructure details
• Installing, uploading, or running security tools including but not limited to: nmap, Metasploit, sqlmap, Burp Suite, Nikto, Hydra, Gobuster, Wireshark, or any similar software
• Attempting privilege escalation, unauthorized access to other tenants' data, or any action intended to exceed your authorized access level

Enforcement: Violation of this section may result in immediate account suspension without prior notice, cancellation of your subscription without refund, permanent ban from the Platform, and reporting to appropriate law enforcement authorities. We actively monitor for security abuse and enforce this policy through automated detection systems.

Intellectual Property

• Our IP: The Platform, its features, design, and underlying technology are owned by TurboAgency. Your subscription grants a limited, non-exclusive license to use the Platform.
• Your Content: You retain ownership of all content you create or upload to the Platform, including client data, campaign assets, and generated outputs.
• AI-Generated Content: Content generated by our AI tools belongs to you upon generation. You are responsible for reviewing AI-generated content before use.

White-Label Usage

Plans that include white-label features allow you to rebrand the Platform interface with your agency's branding. White-label usage does not transfer ownership of the Platform technology.

Data and Privacy

Your use of the Platform is also governed by our Privacy Policy. You are responsible for ensuring your use of client data complies with applicable data protection laws (GDPR, CCPA, etc.).

Service Availability

We target 99.9% uptime but do not guarantee uninterrupted service. We reserve the right to perform maintenance with reasonable notice. We are not liable for downtime caused by factors outside our control.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TURBOAGENCY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify TurboAgency against any claims arising from your use of the Platform, your violation of these Terms, or your infringement of any third party's rights.

Termination

Either party may terminate your account with 30 days' written notice. We may suspend or terminate your account immediately for violation of these Terms. Upon termination, your right to use the Platform ceases, and we will delete your data per our retention policy.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law provisions.

Changes to Terms

We may update these Terms periodically. Continued use of the Platform after changes constitutes acceptance. Material changes will be communicated via email.
